नीरव मोदी और वह फर्म जिनको वो देखते हैं, कथित रूप से बैंकिंग प्रणाली में लूप होल का काम कर रहे हैं (एलओयू) पत्र लिखकर और अपने व्यापारियों के भुगतान के लिए विदेशी बैंकों से क्रेडिट जमा करते हैं। एलओयू एक विदेशी मुद्रा भुगतानों के लिए एक बैंक गारंटी है। पिछले सात वर्षों से नीरव मोदी और उनकी तीन कंपनियां – डायमंड आर यूएस, सोलर एक्सपोर्ट्स और स्टेलर डायमंड- कथित तौर पर पीएनबी की ब्रैडी रोड शाखा से एलओयू खरीद रहे थे।
